1. Acceptance of Terms
By accessing and using the website and services of NOEM Luxury Homes, LLC d/b/a NOEM Luxury Stays (hereinafter referred to as "NOEM Luxury Stays," "we," "us," or "our"), you accept and agree to be bound by these terms and conditions. If you do not agree to these terms, do not use our website or booking services.
2. Booking and Rental Terms
2.1 Booking Process
All bookings must be made through our official website or authorized booking platforms. The renter must sign a rental agreement and provide valid government-issued ID at time of booking. Full payment is required at time of booking to confirm reservation. Guests must be at least 25 years of age to make a booking. No booking is confirmed until all required documentation is received.
2.2 Payment Terms
Full payment is required at time of booking. No security deposit is required. Additional fees include cleaning fees (which vary by property) and a pet fee of $200 (maximum one dog allowed). No extra guests are permitted beyond the maximum occupancy for the property.
2.3 Cancellation Policy
Cancellation and refund policies vary based on specific property, season, and time of booking. Please refer to individual property listings for specific cancellation and refund terms. Force majeure events will be evaluated on a case-by-case basis.
2.4 Check-in/Check-out
Check-in time is 3:00 PM. Check-out time is 10:00 AM. Self check-in instructions will be provided 24 hours before arrival.
3. Property Usage Rules
3.1 House Rules
Maximum occupancy varies by property and is strictly enforced, with no extra guests permitted. No parties or events of any kind are permitted. Quiet hours are from 10:00 PM to 8:00 AM. No smoking is allowed inside the property. All vehicles must park in the driveway. We reserve the right to terminate your stay immediately without refund for any rule violations, neighbor complaints, or police involvement.
3.2 Guest Responsibilities
Guests must report any damage immediately and follow all check-in/check-out procedures. Guests must comply with all house rules, including the strict no-party policy, and respect neighbors and community guidelines. Guests must secure the property when leaving and may not exceed maximum occupancy or host any gatherings. Any rule violations, neighbor complaints, or police involvement will result in immediate termination of stay without refund.
4. Website Usage and Privacy
4.1 Information Collection
NOEM Luxury Stays collects and stores guest identification and contact information, payment details, communication records, and stay history. Security cameras and noise monitoring devices are installed on the exterior of all properties. No cameras or monitoring devices are located inside any property. Exterior monitoring is used for security purposes and noise ordinance compliance.
4.2 Data Usage
Information collected is used for booking administration, legal compliance, service improvement, and marketing (with consent). Data may be shared with cleaning services, payment processors, and legal authorities (if required).
5. Right to Terminate Stay
NOEM Luxury Stays maintains the right to immediately terminate your stay without refund if any house rules are violated, we receive complaints from neighbors, police are called to the property, noise monitors or security cameras detect rule violations, maximum occupancy is exceeded, unauthorized pets are found on the property, smoking is detected inside the property, or any illegal activities occur on the property. In the event of stay termination, guests must vacate the property immediately. No refunds will be provided for early termination due to rule violations.
6. Intellectual Property Rights
6.1 Content Ownership
All content on this website, including but not limited to text, property descriptions, images, videos, graphics, logo and branding elements, website design, property listings, and pricing strategies, is owned by NOEM Luxury Homes, LLC d/b/a NOEM Luxury Stays and protected by applicable copyright and intellectual property laws.
6.2 Prohibited Usage
Users are prohibited from copying, reproducing, or duplicating any content from our website; using our property descriptions, images, or other content for any commercial purpose; scraping, data-mining, or automatically collecting any content; modifying or creating derivative works from our content; redistributing or republishing our content on other platforms; using our content for competitive purposes; or removing any copyright or proprietary notices.
6.3 Limited License
Users are granted a limited, non-exclusive license to view content for personal, non-commercial use only. This license does not include the right to copy, distribute, or modify any content. Any unauthorized use terminates this license automatically.
7. Indemnification and Insurance
7.1 Guest Indemnification
Guests agree to indemnify, defend, and hold harmless NOEM Luxury Homes, LLC d/b/a NOEM Luxury Stays, its owners, employees, managers, agents, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from guest's breach of these terms, guest's use of the property, any harm caused to other guests, neighbors, or property, violations of laws or regulations, and any claims made by third parties due to guest actions.
7.2 Property Damage and Insurance
Guests are responsible for any damage beyond normal wear and tear and acknowledge they may be liable for damages exceeding standard insurance coverage. Guests are encouraged to obtain their own travel/rental insurance. Any disputes over damage will be documented with photos and itemized repair costs. Guest credit card on file may be charged for verified damages. NOEM Luxury Homes, LLC reserves all rights to pursue additional damages beyond credit card charges.
7.3 Liability for Personal Property
NOEM Luxury Homes, LLC d/b/a NOEM Luxury Stays is not responsible for any lost, stolen, or damaged guest property. Guests are responsible for securing their valuables and personal items. Left items may be returned at guest's expense if requested within 7 days.
8. Dispute Resolution
8.1 Governing Law
These terms are governed by Kansas state law. Any disputes shall be resolved in Kansas courts. Guest agrees to submit to the jurisdiction of Kansas courts.
8.2 Dispute Process
All disputes must first attempt resolution through direct communication. Written notice of disputes must be provided within 30 days of occurrence. Small claims are to be resolved through arbitration. Guest is responsible for all reasonable attorney fees if NOEM Luxury Stays prevails.
8.3 Class Action Waiver
Guests waive any right to participate in class actions against NOEM Luxury Stays. All disputes must be handled on an individual basis.
9. Liability and Disclaimers
To the maximum extent permitted by law, we exclude all representations, warranties, and conditions relating to our website and services. We do not warrant the completeness, accuracy, or availability of the website. We are not liable for any loss or damage resulting from website usage, booking platform technical issues, third-party payment processing, or force majeure events. This disclaimer does not limit liability for death or personal injury, limit liability for fraud, or exclude any liability that cannot be excluded under applicable law.
